 SINGLE-CLASS TRADEMARK REGISTRATION FOR LOCAL OR PHILIPPINE ENTITIES
What are included in the package? TRIPS shall provide you trademark services from the filing of a single-class trademark application, up to the registration of the mark in the IPO’s registry of marks. The package fee includes the following: 1. Our professional fees, which cover almost a two-year period for the following work: a) Completion of the single class trademark application in accordance with the IP Code; b) Preparation of the required Formal Drawings and ten (10) facsimiles, to be submitted together with the application; c) Preparation of the Special Power of Attorney and Secretary's Certificate, empowering TRIPS or any of its representatives to file and prosecute the application; d) Notarization of the application, SPA, Secretary's Certificate, and other necessary documents which the IPO may now or hereafter require; e) Follow-ups with the IPO regarding the status of the application, to facilitate the examination of the application; f) Filing of responses to the Trademark Examiners' Registrability Reports as may be necessary to traverse any objections to the registration of the mark; g) Response to the IPO's Notice of Allowance and Publication for purposed of Opposition h) Monitoring of the application’s publication; i) Monitoring of any opposition to the mark; j) Response to the IPO’s Notice of Issuance and Publication, after the subject mark has been approved for publication in the IPO's Official Gazette; k) Constant monitoring of status of the application; l) Conference with the Trademark Examiner; m) Securing of the Certificate of Registration; and n) Filing of 3rd year Declaration of Actual Use 2. Government fees 3. Notarization fees 4. Expenses (such as photocopying, printing expenses, call & facsimile charges, transportation expenses, representation expenses, mailing charges, etc.) 5. With just P30,000, you can protect your business and have your trademark registered by professionals! What are not included in the package fee? 1. Appeal to Bureau Director; 2. In the event that there is an opposition filed by a third party to the registration of the mark, the nature of the case is transformed into an adversarial proceeding before the Bureau of Legal Affairs of the IPO. Said proceeding is not covered by the Agreement. 3. Additional class 4. Claim of color 5. Claim of convention priority We may cater to your special needs. What information do you need to furnish us? 1. Your name or corporate name 2. Your business address 3. Small or big entity (You are a small entity if your assets are worth P20 Million or less) 4. Mark 5. Soft copy of the drawing of the mark 6. Color claimed (We suggest that you do not claim color so there is broader protection) 7. Goods/services covered 8. Special Power of Attorney (SPA) authorizing us to file and prosecute the application.
